Privacy policy of Quadrum Foods Spółka z o.o. (Limited Liability Company)
The privacy policy of Quadrum Foods Sp. z o.o. (Limited Liability Company) presented below applies to personal data provided to us through the qf.com.pl website, as well as personal data obtained by us in the course of our business activity, including in connection with the preparation, conclusion and performance of contracts, and also personal data collected by the company in the recruitment processes.
As of 25 May 2018, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and on the repeal of Directive 95/46/EC (hereinafter referred to as "GDPR") and the Act of 10 May 2018 on the protection of personal data entered into the Polish legal system. Privacy policy of Quadrum Foods Sp. z o.o. (Limited Liability Company) is in accordance with the GDPR.
The administrator of personal data - i.e. the entity deciding on the manner of processing the protected entity's personal data is Quadrum Foods Spółka z ograniczoną odpowiedzialnością with its registered office in Kraków 31-523 Kraków, ul. Moniuszki 22A; (Quadrum Foods Sp. z o.o.) entered in the Register of Entrepreneurs kept by the District Court for Kraków-Śródmieście in Kraków, XI Economic Department of the National Court Register under KRS number 0000939001.

Protected entity - a natural person whose personal data is processed by the Administrator for one or more of the purposes indicated in this privacy policy.
Sources of personal data
The personal data comes from:
- contact persons, directing a query through the qf.com.pl website, sending messages to any address under the qf.com.pl domain and providing QF with their details during a personal or telephone contact or even by passing them on to our employees during a meeting,
- the employer or the entity represented by the person providing personal data where it is related to the performance of his or her employment and/or professional duties,
- third parties, such as web portals to which personal data have been provided by individuals.
Purpose, basis and duration of processing of personal data by the Administrator
Personal data will be processed by QF for specific, explicit and legitimate purposes and not further processed in a way incompatible with those purposes.
Personal data will be used for the following purpose:
- the conclusion and performance of the contract with the contractor pursuant to Article 6(1)(b) of the GDPR - for the duration of the preparation and the duration of the contract, as well as the limitation period for any claims,
- issuing and storing invoices and accounting documents,
- ensuring network and IT system security,
- the performance by the QF of its obligations (Article 6(1)(c) of the GDPR), including the carrying out of financial audits, for the duration of those obligations and no longer than the limitation period for possible claims,
- contacting the protected person in matters related to business cooperation, including the execution of contracts between the QF and the protected person or their employer or represented entity, receiving orders, presenting offers, answering questions by phone or e-mail (for the duration of the cooperation, and not longer than the period of limitation of possible claims),
- marketing activities carried out by the QF on the basis of and within the scope of the consent granted to the QF until it is withdrawn, and not longer, however, than until the statute of limitations for possible claims,
- registering a protected person to participate in competitions and events organised by the QF, enable him/her to take part in the competition or event, including sending his/her information on the basis of and within the scope of the consent given to the QF for a period of 2 years from giving consent, and no longer than until the statute of limitations on possible claims,
- registering such a person to participate in QF loyalty programs, including sending information on the basis of and within the scope of the effectively granted consent to QF until it is withdrawn, but not longer than for the period of limitation of possible claims,
- conducting marketing activities, including direct marketing and QF profiled advertisements, carried out by QF or third parties (until an objection is raised, and not longer than the period of limitation of possible claims),
- answering the questions asked to QF representatives during the telephone conversation and, if necessary, to contact the person concerned again - for the purpose of presenting and discussing the offer (for a period of one year from the date of contacting QF, but not longer than the period of limitation of possible claims),
- taking protection against or pursue possible claims related to the contract with the person or entity represented by it,
- in the implementation of the legally justified interest of the QF (Art. 6.1.f of the Council of Ministers), inter alia, the need to conduct marketing activities, contact with contractors of the QF in matters related to its activities, as well as to defend the property and non-property interests of QF before common courts and government and local government administration bodies,
- to the extent that the prior consent to processing has been granted (Article 6(1)(a) of the GDR), until such time as it is effectively revoked or the purpose for which the processing took place ceases.
The QF informs that in accordance with Article 7(3) of the GDPR, the withdrawal of consent to the processing of personal data does not affect the lawfulness of the processing carried out on the basis of such consent before its withdrawal.
Types of personal data to be processed
The types of data are different because of the source of the data:
- identification and contact details, such as your name, position and place of work, address, telephone number, PESEL number, NIP, e-mail address;
- data concerning the person's preferences and interests in the offer, such as e.g. type of goods, size of orders, delivery conditions.
Recipient/addressee of personal data
- institutions and offices empowered by law,
- entities to which the QF subcontracts the performance of services related to the processing of personal data (processor), e.g. web portals for the provision of information on a given commodity, entities administering IT systems,
- business entities related to the QF, performing administrative and accounting services for the QF and furthermore, if there is a legitimate interest in sending personal data for internal economic and administrative purposes between them,
- authorised staff of QF and affiliates to carry out the duties imposed on them,
- other recipients of the data - e.g. forwarding and transport companies, customs agencies, banks, tax advisors, law firms, postal and courier companies, etc.
Personal data processing by QF - the scope of rights of participating entities
As a rule, the person making contact with QF is not obliged to provide personal data. Anonymous or limited personal information will not, however, allow contact to be made by sending an offer, price lists, advertising and promotional materials and other data necessary to complete commercial transactions. Personal data will also be necessary for the conclusion and execution of contracts. They are also necessary in the event that the obligations incumbent on the Administrator under the relevant provisions are fulfilled.
In cases of processing of personal data not resulting from the provisions of law, the Administrator shall request the protected person's consent for a specific use/processing of personal data. The person concerned may withdraw consent at any time.
Powers of the protected entity
The protected person is entitled to the following rights with regards to the processing of his or her personal data:
- demand access to their personal data processed by QF and the right to rectify, delete them ("right to be forgotten"),
- the right to object to the processing of personal data for direct marketing purposes, resulting in the cessation of data processing by QF for direct marketing purposes,
- the right to object on grounds relating to the special situation of the protected person if QF processes personal data on the basis of a legitimate interest. This right does not exclude the possibility of further processing of personal data to the extent necessary, provided that there is a legitimate reason on the side of the QF,
- the right to transfer data processed in connection with the performance of the contract or on the basis of the consent given, and the right to restrict data processing,
- where the processing of personal data is based on the protected person's consent, the protected person has the right to withdraw his or her consent at any time. Withdrawal of consent does not, however, affect the lawfulness of the processing of personal data by QF, carried out before the effective withdrawal of consent.
Supervisory authority regarding personal data Complaint for infringement of personal data processing rules.
The supervisory authority in the scope of compliance with the law in relation to the processing of personal data is the President of the Office for Personal Data Protection.
In case the QF violates the rules of personal data processing, the person whose rights have been violated has the right to submit a complaint to the President of the Office for Personal Data Protection.
